PRIVACY NOTICE OF SMAS PROPERTY MANAGEMENT, S.A.P.I DE C.V.
SMAS Property Management, S.A.P.I. of C.V. (hereinafter “Brickon”) with address at Bosque de Radiatas 54 – 102, Bosques de las Lomas, Cuajimalpa de Morelos, 05120, CDMX, recognizes the importance of legitimate, controlled and informed treatment of your personal data, in order to guarantee your right to privacy and informational self-determination. This Privacy Notice is made available to you so that you are aware of Brickon’s practices when obtaining, using, disclosing and/or storing your personal data. The foregoing, in compliance with the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the “Law”).
The following are, but not limited to, some of the personal data that Brickon may collect for the provision of its services:

Brickon will process your personal and/or corporate data only for as long as necessary in order to fulfill the purposes described in this Privacy Notice and/or in accordance with what is established by applicable legal provisions, including the Law.
For what purposes do we collect personal data?
The personal data that Brickon collects is used to provide the services offered, to develop and improve our services, to contact you, to communicate and inform you about our services, for the creation and administration of projects, to carry out marketing and promotional activities. , to provide you with the specific services of each of the service areas in which you have registered, to provide you with access to and information on services that we consider may be of interest to you, to interrelate databases and know your profile and needs, to carry carry out billing for the services provided, to send electronic invoices to the email provided, to manage collection and payment processing, to implement protection measures against possible fraudulent transactions or identification of the same and, in general, to comply with the development of the commercial relationship.
Your personal and corporate data may be used for other purposes as long as said purposes are provided for in the Law.
Social networks constitute a platform for communication and interconnection between digital platforms of different users. Said platforms are external to Brickon and the information that you provide within social networks in which Brickon participates as a user, does not constitute or form part of the personal data subject to the protection of this Privacy Notice, being the responsibility of the company providing that platform and who publishes it.
What communications of your personal data may be carried out?
Brickon may share your personal data with third parties, national or foreign, in order to fulfill the purposes described above. The third parties to whom Brickon may communicate your personal data are for example: other affiliated companies or subsidiaries of Brickon; external professional advisers acting in the name and on behalf of Brickon; service providers that are contracted to fulfill the purposes described and that act in the name and on behalf of Brickon.
When Brickon shares your personal data with third parties, it will ensure that said third parties take the necessary measures to protect the confidentiality and security of your personal data. Brickon will require such third parties to comply with Brickon’s Privacy Notice and Privacy Policy and will prohibit them from using your personal data for any purpose other than that for which it was collected.
Likewise, Brickon may communicate your personal data to third parties, national or foreign, independent of Brickon, when it has the purpose of complying with a legally acquired obligation, is required by resolution or determination of a competent authority, there is an emergency situation that puts at risk your person or your property or when said communication of data is provided for in a Law.
How do we protect your personal data?
Brickon has adopted the security, administrative, technical and physical measures necessary to protect your personal data against damage, loss, alteration, destruction or unauthorized use, access or treatment.
Access to your personal data, held by Brickon, will be limited to those who need access to said information, in order to carry out the purposes identified in this Privacy Notice.
Brickon undertakes that the information provided by you will be treated in accordance with the Law and its Regulations.
What rights and obligations correspond to you as the owner of personal data?
You, as the owner of personal data, may exercise before the Legal Representatives of Brickon, the rights of access, rectification, cancellation and opposition, in accordance with the Law, and in accordance with the following:
* Right of Access.- to be informed which of your personal data is contained in the Brickon databases, what they are used for, the origin of said data and the communications that have been made with them.
* Right of Rectification.- that your personal data be corrected or updated in case they are inaccurate or incomplete. You will have the obligation to inform Brickon of the changes that must be made to your personal data, when said changes are only known to you and are attributable to you.
* Right of Cancellation.- that your personal data be removed from the Brickon databases. This request will give rise to a blocking period after which the deletion of the data will proceed.
* Right of Opposition.- oppose for legitimate reasons the processing of your personal data by Brickon. In cases where the opposition is based on the reception of certain communications, said communications will include the option to leave the distribution list and stop receiving them.

Your requests must contain the minimum requirements contained in article 29 of the Law, and comply with the guidelines established in article Twenty Eight of the Guidelines of the Privacy Notice, published in the Official Gazette of the Federation on January 17, 2013. Brickon will notify you within a maximum period of 20 days from the date of receipt of your request the decision adopted, so that if it is appropriate, it becomes effective within the following 15 days.
How do we communicate changes to the Privacy Notice?
In the event of changes, modifications and/or updates to this Privacy Notice, of which Brickon reserves the right to make at any time, they will be made available to you on the Brickon website Lack of opposition to the Notice of Privacy modified, within 5 business days following its publication, will be understood as acceptance and consent to the terms established therein.
To whom should you direct doubts or comments and before whom are the rights of access, rectification, cancellation and opposition exercised?
If you have questions or comments regarding the Privacy Notice or if you would like to exercise any of the rights that correspond to you in terms of the Law and its Regulations, we ask you to contact the Department of Personal Data Protection of Brickon, through the following email address esr@brickon.mx. The Brickon Personal Data Protection Department will address any questions you may have regarding the processing of your information.
If the user uses the Brickon services, it means that said user has read, understood and agreed to the terms and conditions set forth in this Privacy Notice, published on the Brickon website. If you do not agree with them, the user should not provide any personal information, or use our services.
